ROMA İMPARATORLUĞU’NDAN GÜNÜMÜZE FIDEICOMMISSUM FAMILIA FIDECOMMISSUM FAMILIA FROM ROMAN EMPIRE TO PRESENT TIME Berk Hasan ÖZDEM* Özet: Latince fides (güven) ve committere (teslim etmek) sözcüklerinin bir araya gelmesi ile oluşan Fideicommissum sözcüğü “güvenli ellere bırakmak, teslim etmek” anlamına gelmektedir. Fi- deicommissum Familia ise bir kimsenin bir irade açıklamasıyla mal varlığında bulunan bir malı, kendisinin öngördüğü intikal sırasına göre ve üzerinde tasarrufta bulunmasını yasaklayacak şekilde aileye özgülemesidir. Köklerini Roma Hukuku’nda Fideicommissum Fami- lia kurumunun Orta Çağ ile devam eden serüveni, özellikle Fransız Devrimi’nin feodalizme üstün gelmesiyle, uygar hukuk sistemlerinin birçoğundan silinene kadar, arkasında çeşitli maddi ve manevi moti- vasyonlar barındırmıştır. Bu yazıda Augustus döneminde yasal for- masyonuna kavuşan Fideicommissum kurumunun kökleri ele alınmış, ayrıca Roma İmparatorluğu döneminden günümüze dünyanın çeşitli bölgelerinde oynadığı roller ve Türk Medeni Kanunu’ndaki düzenle- nişi üzerinde durulmuştur. Anahtar Kelimeler: Fideicommissum Familia, Mirasçının İkam e- si, Omnis Hereditas, Oneratus, Substutitio Fideicommissaria Abstract: The word Fideicommissum , which is formed by the Latin words fides (confidence) and committere (commit), means “to leave in safe hands”. Fideicommissum Familia is the allocation of a property to a family according to the foreseen order of succes- sion by means of a will that prohibits the disposal of the property. With its origins from Roman Law, the adventure of the institution of Fideicommissum Familia which goes alongside with the Medieval Epoque, until being swept from many jurisdictions with the victory of the French Revolution agains feodalism had kept various materi- al and spiritual motivations in itself. This paper emphasizes on the roots of the Fideicommissum which had its legal formation in the pe- riod of Augustus, the role it played from the Roman Empire period to present time at different regions of the world and its regulation in Turkish Civil Code.
