DİSİPLİN SORUŞTURMASINDA DELİL VE İSPAT EVIDENCE AND PROOF IN DISCIPLINARY INVESTIGATION Veysel Candan CANOĞLU * Özet: Her bir kısmi düzen kendi işleyiş ve disiplinini sağlamak zorundadır. Bu kapsamda bazı eylemler yasaklanmakta ve bu eylem- lerin işlenmesi halinde belirli yaptırımlar öngörülmektedir. Disiplin cezası vermek içinse doğrudan ceza verme yasağına göre disiplin soruşturmasının yapılması zorunludur. Disiplin soruşturmasında, disiplin suçuna ilişkin deliller toplan- maktadır. Bu kapsamda soruşturulan ve tanıkların ifadesi alınabil- mekte, kurumlardan yazı ve belge talep edilebilmekte, keşif yapıla- bilmekte, bilirkişiden rapor alınabilmekte ve hukuka uygun her türlü yöntem ile delil elde edilebilmektedir. Bu deliller disiplin amiri veya kurulu tarafından serbest bir şekilde değerlendirilmektedir. Çalışmamızda disiplin soruşturmasında kullanılabilecek deliller ile disiplin suçunun ispatı noktasında delillerin değerlendirilmesi ko- nuları açıklanmaktadır. For this purpose, some actions are prohibited and certain sanctions are issued when these actions are processed. According to the prohibition of direct punishment, disciplinary in- vestigation is necessary to punish. The evidence is collected through disciplinary investigation. Within this scope, the interrogation of the suspect and witness can be taken, information and documents can be requested from insti- tutions, view can be made, can get repot from expert and evidence can be obtained by any method appropriate in the law. These evi- dences are freely assessed by the disciplinary chief or delegation.
