258 Türk Soylu Yabancıların Türkiye’de Çalışma Hakkı ve Uygulamada Karşılaştıkları Sorunlar Abstract : Labor right is a fundamental human right which gu- arantees to have a job everybody desires and a life with an income which protects human dignity. Labor right is explained in 23 rd article of Universal Declaration of Human Rights like this: “... Everyone has the right to work, to free choice of employment, to just and favourable conditions of work ”. As it is understood from the provision, labor right is guaranteed for everybody without making any discriminations. Same provision is present in some international documents. Labor right is accepted as a fundamental human right in natio- nal constitutions as well as in international documents. Thus, labor right was guaranteed with 48 th article of 1982 Constitution and this provision set forth: “ Everybody has the right to work in desired place and a freedom of contract ”. With the word “ everybody ” in this provision it is seen that there is no discrimination among the people and the function of principle of equality. Hence, foreigners are in the scope of “ everybody ” as well as citizens. This means that foreigners also have the labor right in Turkey. However, as our study is limited with labor rights of foreigners of Turkish origin and the problems they face while they carry out this right in Turkey in the concept of foreign natural entities, our evaluations will be in this direction.
