TİCARİ İŞLERDE FAİZ VE YARGITAY UYGULAMASI INTEREST IN COMMERCIAL AFFAIRS AND THE APPLICATION OF THE SUPREME COURT Yasemin YÜCESOY YILMAZ* Özet: Konusu bir miktar para olan borçlarda, para alacağından belirli bir süre mahrum kalınması sebebiyle ödenen bedele faiz de- nilmektedir. Faiz, konusu bir miktar para olan borçlarda söz konu- su olmaktadır. Konusu para alacağı olmayan borçlarda, faiz alacağı doğmamaktadır. Faiz, gerek doktrinde ve gerekse uygulamada çeşitli açılardan sınıflandırmaya tabi tutularak incelenmektedir. Yapılan bu sınıflan- dırmalardan birisi de adi işlerde faiz ve ticari işlerde faiz ayrımıdır. Ticari nitelikte olmayan işlerde uygulanacak faize, adi faiz denilmek- tedir. Ticari nitelikte olan işlere uygulanacak faize ise, ticari işlerde faiz denilmektedir. Ticari işlerde faiz, oran serbestisi, bileşik faiz uy- gulanabilmesi ve kararlaştırılmamış olmasına rağmen faiz istenebil- mesi yönünden adi işlerden farklılaşmaktadır. Interest is a matter of debt, which is a subs- tantial amount of money. Interest does not come into question in cases where a debt is not a certain amount of Money. Interest is examined both in the doctrine and in practice intovarious classifica- tions. One of these classifications is interest in ordinary affairs and interest in commercial affairs. The interest that is applied to the affa- irs that are not of commercial nature is called ordinary interest. The interest that is applied to businesses of commercial nature is called interest in commercial affair. Interest in commercial affair differs from the interest in ordinary affairs in rate release and in compound interest and also commercial interest can be requested even though it is not agreed by the parties.
