CEZA MUHAKEMESİ HUKUKUNDA BEDEN MUAYENESİ VE VÜCUTTAN ÖRNEK ALMA INSPECTION OF THE BODY AND TAKING SAMPLES IN CRIMINAL PROCEDURE Recep DOĞAN * Özet: Bu makalede şüpheli, sanık veya diğer kişilerin beden muayenesi ve vücudundan örnek alınması kavramları, Ceza Muha- kemesi Kanunu’na ve ilgili Yönetmelik hükümlerine göre tartışıla- cak olup konuya ilişkin tartışmalı hususlar ve uygulamada yaşanan tereddütler mukayeseli hukuka ilişkin yargı kararlarından ve Avrupa İnsan Hakları Mahkemesi kararlarından örnekler vermek suretiyle açıklanacaktır. Ayrıca kanunda ayrıntılı bir şekilde düzenlenmeyip yönetmelik ile düzenlenen bazı konulara ilişkin uygulamada yaşanan tereddüt ve sorunlar ile söz konusu düzenlemelerin ihtiyaca yanıt ve- rip vermediği hususları değerlendirilecektir. Anahtar Kelimeler : Beden Muayenesi, Vücuttan Örnek Alma, Ceza Muhakemesi, Vücut Bütünlüğünün Dokunulmazlığı, Hukuka Uygun Delil Abstract: This article discusses the issues of the inspection of the body and taking samples from the body with a reference to Turkish Criminal Procedure Act 5271 and the relevant regulations. The different interpretations and applications of the relevant regu- lations and provisions of the Turkish Criminal Procedure Act which need to be explained further, will be explored in the light of court rulings from different jurisdictions and the rulings of the European Court of Human Rights. The issue of whether current regulations meets the need of the justice and public safety practitioners and the problems arising out of different interpretations of these regulati- ons will also be explored.
