4708 SAYILI KANUN ÇERÇEVESİNDE YAPI DENETİM KURULUŞUNUN İŞ SAĞLIĞI VE GÜVENLİĞİ SORUMLULUĞU OCCUPATIONAL HEALTH AND SAFETY RESPONSIBILITY OF BUILDING INSPECTION AUTORITY WITHIN THE LAW NO.4708 Barış DUMAN* Özet: İşyerinde işin yürütümü nedeniyle meydana gelip, ölü- me sebebiyet veren veya vücut bütünlüğünü ruhen ya da bedenen engelli duruma getiren olayların önlenmesinde yapı denetim kurulu- şunun sorumluluğu ikincil nitelikte olup; bu kuruluşlar, iş sağlığı ve güvenliğini sağlamakta veya risklerini önlemekte birinci derecede rol almazlar. Bu kuruluşlar sadece inşaat işyerinde mevzuatın öngördü- ğü önlemlerin alınıp alınmadığını kontrol edecekler, bir aykırılık gör- düklerinde yükleniciyi uyaracaklar, bu uyarı etkili olmadığında ise du- rumu ilgili Çalışma ve İş Kurumu İl Müdürlüğüne bildireceklerdir. Bu çalışmada yapı denetim kuruluşlarının söz konusu yükümlülüğünün mahiyeti üzerinde durulmuştur. Anahtar kelimeler: İş Kazası, İş Sağlığı ve Güvenliği, Yapı De- netimi Abstract: The responsibility of the building inspection autho- rity in the prevention of incidents caused by the execution of the work in the workplace, causing death or causing the body to be mentally or physically disabled is secondary, and providing occu- pational health and safety or preventing related risks are not the primary tasks of these authorities. These authorities only inspect whether legal precautions are taken or not in a construction site, but if they see a contradiction, they will warn contractor, and if this warning is not effective then they will report the current situation to provincial directorates of labour and employment agency. In this study, the nature of the mentioned obligation of the building ins- pection authority is emphasized.
