TÜRKPATENT KURUMU NEZDİNDE PATENT EDİNME SÜRECİNİN HUKUKİ DEĞERLENDİRMESİ LEGAL ASSESSMENT OF OBTAINING PATENT PROCESS THROUGH THE TURKISH PATENT AND TRADEMARK OFFICE Onur SARI * Özet: Patentin, teknolojinin ilerlemesinde önemli bir mihenk taşı olan buluşların korunmasında, önemli bir rolü bulunmaktadır. Ancak patent korumasını elde etmek oldukça meşakkatli bir süreç sonucunda mümkün olacaktır. Bu süreç temel olarak ön araştırma süreci, şekli, inceleme, araştırma raporu, patent başvurusunun ya- yımlanması, inceleme ve itiraz olmak üzere altı aşamadan oluşur. Başvuranın bu aşamaları başarıyla atlatması gerekir. Bununla birlikte başvuru konusu olan buluşunda patent verilebilirlik koşullarını taşı- ması gerekir. Başvuran buluşun patent verilebilirlik koşullarını taşı- dığını patent başvurusuyla ileri sürecektir. Bu süreçte patent başvu- rusunun bir parçası olan istem ve tarifnamelerin ise önemli bir rolü bulunmaktadır. Nitekim buluş, istemler ve tarifname kapsamında korunacaktır. However, it would be possible to achieve patent pro- tection as a result of a very difficult process. This process consists mainly of six stages: preliminary research process, formalities exa- mination, search report, publication of patent application, patent examination and objection. The applicant should successfully comp- lete these stages. Moreover the invention must bear the require- ments of the patentability. The applicant will propose with patent application that the invention has the requirements of patentability. In this process, claims and descriptions which are part of the patent application have an important role. Because the invention will be protected in the context of the claims and description.
