ALMAN CEZA KANUNU’NDA YARAR KABUL ETME SUÇU (YEMLEME) (Md. 331) THE CRIME OF ACCEPTING BENEFIT IN THE GERMAN PENAL CODE (FEEDING) (Art. 331) Recep KAHRAMAN* Özet: Kamusal faaliyetin yerine getirilmesinde kamu görevli- sinin haksız menfaat elde etmesi Alman kanun koyucu tarafından değişik suç tipleri yaratılarak yaptırıma bağlanmıştır. Rüşvet suçuna benzer olan yarar kabul etme suçunda kamu görevlisi elde ettiği hak- sız menfaatin sebebi belirli olmasa da cezalandırılmaktadır. Kamu görevlisinin yerine getireceği eylem belli olmamasına rağmen men- faat elde etmesi onun yemlenmesi olarak ifade edilmektedir. Rüşvet suçunda menfaatin sebebi belirli olduğuna göre yarar kabul etme suçu kamu görevlisinin sorumluluk alanını genişletmektedir. Birey, kamu görevlisinin iradesini etkileyerek gelecekte tarafsız kalmama- sını, kendi lehine hareket etmesini arzulamaktadır. Kamu görevlisi de bu teklifi kabul ederek kamu idaresine toplum tarafından duyulan güvene, itibara zarar vermektedir. Anahtar Kelimeler: Kamu İdaresi, Kamu Görevlisi, Rüşvet, Yem- leme, Haksız Yarar Abstract: The unlawful benefit of the public official in exchan- ge for the execution of public activity was imposed by the German legislator by creating different types of crimes. In the offense of ac- cepting benefits similar to bribery, the public officer is punished, alt- hough the reason for the unfair benefit he has obtained is not clear. Although the action to be performed by the public official is unclear, gaining benefits is expressed as feeding him. Since the reason for the benefit in bribery is certain, the crime of accepting benefit inc- reases the responsibility of the public official. The individual wishes to influence the will of the public official. He wishes that he will not remain neutral in the future and act in his own favor. By accepting this proposal, the public official undermines the trust and reputation of the public administration.
