AİHM KARARLARININ YERİNE GETİRİLMESİ THE FULFILMENT OF THE DECISIONS OF ECtHR A. Füsun ARSAVA * Özet: AİHM (Avrupa İnsan Hakları Mahkemesi) AİHK’dan do- ğan mükellefiyetlerin üye devletlerden birisi tarafından yerine geti- rilmemesi halinde mükellefiyetin yerine getirilmediğini tespit eder. Bu tespitin gereğinin yerine getirilmesi üye devletlerin mükellefiye- tidir. Mükellefiyetin gereği gibi yerine getirilmemesi durumunda Av- rupa Konseyi Bakanlar Komitesinin yeniden AİHM’ne başvuru imkânı bulunmaktadır. AİHM’nin bununla beraber 2003’ten itibaren kararla- rında ihlâl tespitinin ortadan kaldırılması bağlamında somut öneriler yaptığı görülmektedir. Bu tablo AİHM’nin tespit kararından eda kararı- na geçiş yaptığını ortaya koymaktadır. Makalede AİHM’nin Konvansi- yonda dayanağı olmayan eda kararları yerine yeniden tespit kararları ile ilgili Konvansiyon düzenlemesine dönmesi gerekliliğine ilişkin de- ğerlendirmeler yapılmaktadır. If a member state breaches one or more of these rights and guarantees, the Co- urt delivers a judgment determining the violation. The Committee of Ministers of the Council of Europe has the possibility to bring a state which does not fulfil the obligations before the ECtHR again. The ECtHR, however, appears to have made concrete recommen- dations since 2003 beyond just to determine that a member State has breached rights and guarantees and obligates that state to act accordingly. This article discusses that ECtHR should act within the context of the Convention instead of giving decisions which are be- yond determining the violations.
