YARGITAY KARARLARI IŞIĞINDA MEDENI MUHAKEME HUKUKUNDA TANIK LISTESI WITNESS LIST IN CIVIL PROCEDURE LAW IN THE LIGHT OF THE COURT OF CASSATION’S DECISIONS Cenk AKİL Özet: Medeni muhakeme hukukunda tanık dinletmek isteyen taraflar mahkemeye tanıkların adlarını ve adreslerini içerir bir tanık listesi sunarlar. Hukukumuzda tarafların prensip olarak bir kez tanık listesi verebilecekleri kabul edilmiştir. Bununla birlikte gerek dokt- rinde gerekse yargı kararlarında bu prensibe bir takım istisnalar ta- nınmıştır. Anahtar Kelimeler: Medeni Muhakeme Hukuku, Tanık, Tanık Listesi Abstract: In civil procedure law, the parties wishing to hear witnesses present to the court a list of witnesses with the names and addresses of the witnesses. It is accepted as a rule only in our law that the parties can submit witness lists as a rule once. Howe- ver, in both the doctrine and the judicial decisions, there are some exceptions to this principle. In this review, the principle and the ex- ceptions of this principle will be discussed.
