ALMANYA VE İSVİÇRE ÖRNEKLERİYLE TÜRK HUKUKUNDA BİRLİKTE VELAYET JOINT CUSTODY IN TURKISH LAW WITH GERMANY AND SWITZERLAND EXAMPLES Zeynep Naz GÜNEŞ * Özet: Bu çalışmada, evlilik birliği dışında doğan çocuklar ve boşanma sonrası için Türk hukukunda son yıllarda çokça tartışılan birlikte velayet incelenmiştir. Sırasıyla 2013 ve 2014 yıllarında birlikte velayeti kural ve tek başına velayeti istisna hale getiren Avrupa ülke- lerinden Almanya ve İsviçre düzenlemeleri örnek alınarak, bu ülkele- rin hukuki düzenlemelerinin tarihsel gelişim süreçleri incelenmiş ve Türk hukukundaki gelişmeler ile karşılaştırılmıştır. Türk hukuk doktri- ni hâkim görüş olarak, özellikle boşanmadan sonra, birlikte velayetin uygulamasını desteklemekle birlikte aksi görüşler de mevcuttur. Konu hakkındaki tartışmalar, Türk yargısında ilk olarak 2009 yılında ilk derece mahkemesi ile verilen bir karara istinaden ivme kazanmış olup, Yargıtay da bu süreçte 2017 yılında verdiği kararıyla, birlikte ve- layet lehine içtihat değişikliğine gitmiştir. Anahtar Kelimeler: Velayet, Birlikte Velayet, Tek Başına Vela- yet, Boşanma, Çocuğun Üstün Yararı Abstract: In this study, joint custody is analysed for the children born out of wedlock and after divorce which has been widely discus- sed in Turkish law in recent years. In the years 2013 and 2014, the historical development processes of the legal regulations of these countries were examined and compared with the developments in Turkish law, taking into consideration the German and Swiss regula- tions of European countries which made joint custody as a rule and sole custody as an exception. Although the Turkish legal doctrine supports the joint custody practice as a dominant view, especially after the divorce, there are also other opinions. The discussions on the issue gained a momentum in the Turkish judiciary in 2009 due to the decision of the first-instance court and the decision of Supreme Court of Appeals which is made a change in case-law in favor of joint custody in 2017 with its decision.
