BİYOTEKNOLOJİ HUKUKUNUN TEMEL KONULARI FUNDAMENTAL ISSUES OF BIOTECHNOLOGY LAW Abdurrahman Ali YILDIRIM * Özet: Bu makalede biyoteknoloji hukuku tanıtılarak multidisip- liner bir çalışma alanı olduğundan hareketle, kapsamına dair bilgilen- dirme yapılmıştır. Biyoteknoloji hukukunun ilgilendiği konular ile tıp hukuku ve ticari işletme hukuku gibi alanlarla ilişkili olduğu mesele- ler üzerinde durulmuştur. İlgili mevzuat, temel hükümler, meselele- re somut çözümler ve uluslararası düzenlemeler başlı başına birer çalışma olduklarından, bu doğrultuda genel hatlarıyla değinilmekle yetinilmiş, konu dağıtılmadan temel sorunlar belirlenmeye çalışılmış- tır. Değerlendirmelerde biyoteknoloji uygulamalarının insana yöne- lik olması ve diğer canlılara yönelik olması ayrımından yola çıkılmış- tır. Biyoteknoloji hukukunun ilgi alanları, biyoetik ile ilişkisi ve özel hukuk ile kamu hukuku alanlarındaki ilgili diğer hukuk disiplinleriyle bağlantı noktaları açıklanmıştır. Biyoteknoloji özelinde güncel birta- kım uygulamalar konusunda problemlere ve muhtemel tehlikelere dikkat çekilmiştir. The emphasis is given to the issues that biotechnology law directly deals with, and its related areas such as medical law and business law. Since the relevant le- gislation, comparative law, provisions of international regulations, and presented solutions to the issues are broad research topics that deserve entirely separate studies, the article draws a general outline on them and focuses on the central issues without any distraction. The distinction between biotechnology applications aimed at hu- mans and/or other living creatures is made in the discussions sec- tion. The subjects of biotechnology law, its relation with bioethics, and its connections with other relevant legal disciplines in the fields of private law and public law are explained. Attention is drawn to the problems and possible dangers in certain biotech applications.
