GÜVENİ KÖTÜYE KULLANMA SUÇU (TCK 155/1-2) THE CRİME OF ABUSE OF TRUST (TCK 155/1-2) Fatih ŞAHİN* Özet: Güveni kötüye kullanma suçu, Türk Ceza Kanunu’nda malvarlığına karşı suçlar başlığı altında düzenlenmiştir. Suç, mahi- yeti gereği zilyetlik ve mülkiyet gibi özel hukuka ait kavramları da içinde barındırmakta olup suçun açıklanabilmesi için bu kavramların bilinmesi gerekmektedir. Güveni kötüye kullanma suçu, mülkiyet hakkının yanı sıra güven ilişkisini de korumaktadır. Kişiler arasındaki sözleşme ilişkisine aykırılık ile güveni kötüye kullanma suçu çoğu za- man iç içe geçmekte, ayırt etmek zorlaşmaktadır. Uygulamada, hu- kuk mahkemelerinde çözümü gereken hukuki uyuşmazlıklar şikâyet konusu yapılarak ceza mahkemelerinin önüne gelebilmektedir. Bu iç içe geçmişliğin bir sonucu olarak, suç tipinin analiz edilerek, hangi durumlarda ceza hukuku anlamında cezalandırmayı gerektirir bir ey- lem olduğu, hangi durumlarda ise sorunun hukuk mahkemelerinde özel hukuk davaları ile çözülmesi gerektiği doğru tespit edilmelidir. Due to its nature, crime includes the concepts of private law such as posses- sion and property and these concepts must be known in order to explain the crime. The crime of abuse of trust protect the right to property as well as the relationship of trust. Violation of the cont- ractual relationship and the crime of abuse of trust are often intert- wined and it becomes difficult to distinguish. In practice, it is seen that private law disputes that need to be resolved in civil courts are brought to criminal courts. As a result of this intertwining, the type of crime should be analyzed and it should be determined correctly in which cases its that requires punishment in terms of criminal law and in which cases the problem should be solved by private law ca- ses in the civil courts.
