2017 ANAYASA DEĞİŞİKLİĞİNİN DEMOKRATİK NİTELİK SORUNU DEMOCRATIC QUALITY PROBLEM OF THE 2017 CONSTITUTIONAL AMENDMENT Ömer KESKİNSOY * Semih Batur KAYA ** Özet: Bu çalışma 2017 Anayasa değişikliğinin kuruculuk vasfını de- mokratik perspektifle sorgulamaktadır. 2017 Anayasa değişikliği her şey- den önce bir kurucu iktidar tekniği ortaya koymaktadır. Şu hâlde bu Ana- yasa değişikliğinin kuruculuk vasfının sorgulanması gerekir. Bu çalışmada vardığımız sonuç 2017 Anayasa değişikliğini öngören kurucu iktidarın ge- rek oluşumu, gerek işleyişi bakımından pek çok soruna işaret ettiğidir. Bu sorunlardan en önemlisi demokratik meşruluk meselesidir. İşte çalış- mada bu doğrultuda demokratik kurucu iktidarın vasfı incelenerek de- mokrasi ve hukuk devleti ile ilişkisi ele alınmıştır. Ardından 2017 Anayasa değişikliğinin özellikleri ve demokratik mahiyeti tartışılmıştır. Tüm bunlar dikkate alınarak sonuç bölümünde bir değerlendirme yapılmış ve öneriler sunulmaya çalışılmıştır. Anahtar Kelimeler: Hukuk Devleti, Demokrasi, Kurucu İktidar, 2017 Anayasa Değişikliği, Meşruluk Abstract: This study questions the founding nature of the 2017 Cons- titutional amendment from a democratic perspective. The 2017 Consti- tutional amendment first of all reveals a constituent power technique. Therefore, the founding nature of this constitutional amendment should be questioned. The conclusion we have reached in this study is that the constituent power, which envisions the 2017 Constitutional amendment, points to many problems in terms of both its formation and functioning. The most important of these problems is the issue of democratic legiti- macy. Here, in this direction, the qualification of the democratic foun- ding power has been examined and its relationship with democracy and the rule of law is discussed. Then, the features and democratic nature of the 2017 Constitutional amendment were discussed. Taking all these into consideration, an evaluation has been made in the conclusion section and recommendations have been tried to be presented.
