İNŞAAT SÖZLEŞMESİNDE BEDEL ÖDEME BORCUNUN İFA ZAMANI PERFORMANCE TIME OF THE PAYMENT DEBT IN CONSTRUCTION CONTRACTS Nurcan ARSLAN* Özet: İnşaat sözleşmesi, yüklenicinin yapı inşa etmeyi, iş sahi- binin de bunun karşılığında bedel ödemeyi üstlendiği sözleşmedir. Bedel ödeme borcu, iş sahibinin en temel borcudur. Bu borcun ne zaman ifa edileceği sözleşmede kararlaştırılabilir, sözleşmede karar- laştırılmamışsa kanunda yer alan tamamlayıcı kurallara göre belirle- nebilir. Çalışmada, inşaat sözleşmesi ve bu sözleşmenin en önemli unsurlarından bedel ödeme borcunun ifa zamanına ilişkin kanunda yer alan düzenleme olan Türk Borçlar Kanunu 1 m. 479 incelenmiştir. TBK m. 479’a göre bedel ödeme borcu teslim anında muaccel olur. Bu sebeple bedel ödeme borcunun kanuni ifa zamanı ile bağlantılı olan teslim hususu ve ifanın zamanında yapılmamasının sonuçları da çalışma kapsamına alınmıştır. Son olarak sözleşmenin ifası sırasında ortaya çıkan ve ifa zamanını etkileyen hususlar da inceleme konusu yapılmıştır. Payment dept is the basic dept of the employer. The payment term may be agreed in the contract. If there is no pro- vision on this matter in the contract, it will be determined according to the complementary rules of law. In this study, the construction contract and Article 479 of the Turkish Code of Obligations, in which the time of the performance of the payment dept, which is one of the most important elements of this contract, have been examined. According to the Article 479 of the Turkish Code of Obligations, payment dept becomes due at the time of delivery.
