CEZA MUHAKEMESİNDE SUSMA HAKKI VE BAĞLANTILI HAKLAR RIGHT TO REMAIN SILENT AND RELATED RIGHTS IN CRIMINAL PROCEDURE Yuzarsif Selçuk COŞKUN* Özet: Ceza muhakemesinin amacı maddi gerçeğe ulaşmaktır. Maddi gerçeğe ulaşırken suç şüphesi altındaki kişinin temel hak ve hürriyetlerinin ihlal edilmemesi gerekir. Adil bir yargılanma insan onuruna yakışır bir şekilde yapılmalıdır. Kişinin hak ve hürriyetlerinin ihlali halinde adil bir yargılama olması mümkün değildir. Bu çalışmada, kişinin adil yargılanma hakkı kapsamında bulunan susma hakkına ve kişinin iradesi sakatlanmak suretiyle elde edilen beyanın kişi aleyhine değerlendirilmemesine ilişkin delil yasağına değinilecektir. Bu kapsamda öncelikle susma hakkının tanımına ve diğer haklar ile olan ilişkisine, daha sonra ise susma hakkı ihlallerine ve bu ihlallerin sonuçlarına yer verilecektir. While reaching the material truth, the fundamental rights and freedoms of the person under suspicion of crime should not be violated. A fair trial must be conducted in a manner worthy of human dignity. In case of violation of a person’s rights and freedoms, it is not possible to have a fair trial. In this study, we will touch on the right to remain silent, which is within the scope of the right to a fair trial, and the prohibition of evidence regarding not evaluating the statement obtained by injuring the will of the person against the person. First of all, the definition of the right to remain silent and its relationship with other rights will be given, and then the violations of the right to remain silent and the consequences of these violations will be discussed.
