494 Ceza Mahkemeleri Uluslararası Rezidüel Mekanizması nation. Although the mechanism is a new court, it does not examine new cases. Moreover, it does not have the power to prepare new indictments. It has the power only to terminate existing cases and to have those still on the run to be tried if they are caught. When the Mechanism has accomplished the cases from the International Criminal Courts of the Former Yugoslavia and Rwanda, it will terminate its mandate. Both of the aforementioned international criminal courts were established as ad hoc and their duties would end when the cases were closed. However, some cases could not be completed and some fugitives could not be caught, although it has been a long time since their establishment. Therefore, this court will examine the cases in question, make efforts to catch the fugitives and show the international community that the Rwanda and Former Yugoslavia matters are closed. The Mechanism which established for these purposes, is going to be examined in this study in terms of its functions and jurisdiction. In this context, firstly the development of international criminal law in general, then the International Criminal Courts of Former Yugoslavia and Rwanda will be mentioned. Finally, the current trials of the Mechanism will be examined and a narrow comparison will be made with the International Criminal Court. Bu Mekanizma’nın amacı, sırasıyla 2015 ve 2017 yıllarında faaliyetlerini sonlandıran YUCM ve RUCM’den kalan dosyaları incelemek ve bu mahkemelerin mirasını korumaktır. Rezidüel (residual) kelimesi İngilizce’de kalıntı, arta kalan anlamlarına gelmektedir. Öyleyse Mekanizma isminden de açık olduğu üzere bahsedilen Mahkemelerden arta kalanları bir araya toplayarak sona erdirmek amacıyla kurulmuştur. Bu kapsamda faaliyete geçen Mekanizma’da şu an çeşitli aşamada davalar görülmekte, duruşmalar gerçekleştirilmektedir. Mekanizma YUCM ve RUCM’den kalan dosyaları tamamladığı zaman görevini sona erdirmiş olacaktır. Dolayısıyla Mekanizma yeni bir mahkemedir ancak bu mahkemede yeni davaların görülmesi mümkün değildir.
