Although the individual complaint procedure can be applied for children under different international conventions, with the entry into force of the Third Optional Protocol, applications for a wide range of rights for children have been made possible, and child-sensitive methods have been adopted in the individual complaint process. The aim of this study is to contribute to the protection of children’s rights by explaining in detail the individual application procedure, in terms of protected rights, the functioning and the outcome of the process. Decisions/Views taken as a result of individual complaints determine the scope of children’s rights and affect national laws. The Committee on the Rights of the Child ensures that individual complaints are handled sensitively to children. To this end, it adopts procedural rules on the one hand, and interprets existing rules within the framework of the principles of the best interests of the child and seeking the views of children in its jurisprudence. Keywords: Children’s Rights, İndividual Complaint, Convention on the Rights of the Child, Committee on the Rights of the Child GİRİŞ 1990 yılında yürürlüğe giren Birleşmiş Milletler (BM) Çocuk Hakları Sözleşmesi (ÇHS), çocukları hak sahibi olarak kabul edip çocuklara çok geniş yelpazede haklar tanımakla, çok önemli bir gelişmeye imza atmıştır. Bununla birlikte, Sözleşmenin denetim mekanizması içinde sadece rapor usulüne yer verilmesi, hakların denetlenmesi açısından etkisiz sonuç doğurmuştur ve çocuk haklarının dünya genelinde gerçekleşmesinde fazla yol alınamamıştır. Denetim mekanizmasının güçlendirilmesi için “Başvuru Usulüne İlişkin Çocuk Hakları Sözleşmesi’ne ek İhtiyari Protokol” (Üçüncü İhtiyari Protokol) 2011 yılında kabul edilmiş olup, 2014 yılında yürürlüğe girmiştir. Üçüncü İhtiyari Protokol, denetim sistemine bireysel başvuru, devlet başvurusu ve soruşturma usullerini eklemektedir. Türkiye, Protokol’e 2018 yılından bu yana taraftır. Çalışmamızda toplumun kırılgan kesimi olan çocukların haklarının gerçekleşmesindeki öneminden dolayı özellikle bireysel başvuru usulü ele alınmaktadır. ÇHS, dokuz temel BM insan hakları sözleşmesi içinde bireysel başvuru usulünü bünyesine katan son Sözleşme olmuştur. Bu açıdan, Üçüncü İhtiyari Protokol’ün bireysel başvuru usulünü kabul etmesiyle, BM temel insan hakları sözleşmeleri için eksik halkanın tamamlan-
