VELAYETİN DEĞİŞTİRİLMESİ YARGILAMASINDA İLGİLİLER THE PARTICIPANTS IN THE CUSTODY MODIFICATION PROCEEDING Zeynep Sümeyra DEVECİ* Özet: Hukuk Muhakemeleri Kanunu gereğince velayetin eşlerden birinden alınarak diğerine verilmesine ilişkin yargılama, çekişmesiz yargı işleri arasında yer almaktadır. Bu düzenlemenin sonucu olarak, velayetin değiştirilmesine ilişkin yargılamalar bakımından çekişmesiz yargıya ilişkin kavram ve kurallar uygulama alanı bulacaktır. Çekişmesiz yargı bakımından önem arz eden ve yargılamanın süjesi olarak yargılamada yer alan kişiler, bu yargılamada ilgili olarak adlandırılmaktadır. Velayetin değiştirilmesi yargılaması bakımından da yargılamanın süjesi olan ilgililerin kim olduğunun ve hangi kurallar çerçevesinde yargılamada yer alarak haklarını kullanabileceklerinin tespit edilmesi gerekmektedir. As a result of this regulation, the concepts and rules of non-contentious jurisdiction will be applied to the proceedings on the change of custody. The persons who are important in terms of non-contentious jurisdiction and those who take part in the proceedings as the subject of the proceedings are referred to as participant in these proceedings. It is necessary to determine who are the participants as subjects of the proceedings and according to which rules they can participate in the proceeding and exercise their rights in relation to the change of custody proceedings.
