However, the definition of an attorney contract is not included in the legislation. Although there is no definition in the code, the attorney contract regulated by a particular code can be expressed as a typical contract. It is necessary to accept the attorney contract not as a mere mandate, but as a particular mandate contract with its own characteristics. In cases where there is no provision on attorney contract, a solution will be sought by applying the provisions of mandate contract by analogy. The attorneyship contract is also onerous as a rule. The attorney’s fee is specifically regulated in the Attorneyship Code. According to the Attorneyship Code, the attorney’s fee refers to the amount or value of the legal assistance of the attorney. Not to exceed twenty-five percent, the value of the lawsuit or the thing to be sentenced or a certain percentage of the money can be determined as an attorney’s fee. However, it cannot be agreed that some of the property and rights other than the money that is the subject of the lawsuit will belong to the attorney. The parties may not decide on the amount of the fee in the attorney’s contract, or they can determine it. In the contract, if the fee issue is not regulated or the fee agreement is invalid, how the attorney’s fee will be determined is regulated in Attorneyship Act. However, in cases where the contractual provision regarding the determination of the relative wage contains an excessively high rate, the wage provision shall be deemed invalid and the wage must be determined fairly by the court within the framework of the concrete case, according to the Attorneyship Act Art. 164/4. Since Art. 164/4 provides discretion in a range of ten to twenty percent, in cases where the other party is a consumer, it would be favorable to accept an appropriate rate of at least ten percent by interpreting in favor of the consumer. In other cases, it would be favorable to determine an appropriate rate of up to twenty percent and to award the attorney’s fee accordingly.
