Anahtar Kelimeler: Vekâlet Ücreti, Mahkemeye Erişim Hakkı, Hukuki Belirlilik ve Güvenlik İlkesi, Yargı Ayrılığı Sistemi Abstract: The system adopted in Turkish law regarding the judicial review of the administration is the “jurisdictional dualism system”. As a rule; disputes arising from administrative action, administrative activity and administrative contract are fall under the jurisdiction of the “administrative judiciary branch”. However, the 1982 Constitution do not specify an exclusive jurisdiction for the administrative judiciary. Therefore, with a law to be enacted by the legislature, it is possible to bring a dispute that falls under the jurisdiction of the administrative judiciary to the jurisdiction of the judicial branch. Due to the fact that lawsuits can be filed in both the judicial and administrative jurisdictions in the Turkish judicial system may cause faults for the people who want to file a lawsuit against the administration on which jurisdiction they should file their case in. If a case is filed in the wrong branch of jurisdiction, the trial court dismisses the case, deciding that the case falls within the jurisdiction of the other judicial branch. At this point, there is a fundamental difference in practice between the courts in the judicial jurisdiction and the courts in the administrative jurisdiction. While the courts in the administrative judiciary branch just reject the lawsuit filed in the wrong judicial branch; courts in the judicial branch also award attorney’s fees against the plaintiff. Regulations on how the attorney’s fee will be determined by the courts in both the judicial and administrative branches are included in the Civil Procedure Law No. 6100. Although the courts in both jurisdiction branches are subject to the same legal regulations, the legal problems caused by this difference in practice need to be examined. In our study, the attorney’s fee, which was given in the decision of non-jurisdiction, given by some courts and changed the jurisdictional branch, will be examined in the context of the right to access to court.
