ZORUNLU DEPREM SİGORTASINA TÜRK TİCARET KANUNU HÜKÜMLERİNİN UYGULANMASI APPLICATION OF THE TURKISH COMMERCIAL CODE PROVISIONS TO COMPULSORY EARTHQUAKE INSURANCE Kâmil ÖZBASAN* Ozet: Ülkemizde zorunlu deprem sigorta teminatı, özel bir kanunla kurulan Doğal Afet Sigortaları Kurumu (DASK) tarafından verilmektedir. DASK, sigorta şirketleri gibi anonim şirket veya kooperatif şirket olmayıp kamu tüzel kişisidir. Ancak buna rağmen zorunlu deprem sigortası (ZDS) yönünden sigortacı sıfatına sahiptir. ZDS alt mevzuatı, ZDS sözleşmesine ilişkin özel kanunda hüküm bulunmayan haller bakımından, Türk Ticaret Kanunu’nun koruyucu hükümlerin denetimine tabidir. TCIP is not a joint stock company or cooperative company like other insurance companies, but a public legal entity. However, it still is THE insurer in terms of compulsory earthquake insurance (ZDS). ZDS sub-legislation is under control of the compolsory terms of the Turkish Commercial Code in cases where there is no provision in the special law regarding the ZDS contract.
