Anahtar Kelimeler: ÇED Yönetmeliği, Paydaş Katılım Planı, ÇED Süreci, Kümülatif Etki Değerlendirmesi Abstract: Environmental Impact Assessment (EIA) is essentially an environmental management tool that provides information about the impacts of a project if it is realized to those who decide whether to undertake it or not. The first EIA By-Law in our country was issued on February 7, 1993, 10 years after the Environmental Law came into force. It is the environmental by-law that has undergone the most changes since this date. In addition, it has the feature of being the most discussed and the most controversial environmental by-law in the public opinion during this period. It is very difficult to compare the EIA By-Laws, which have undergone so many changes, by evaluating which one is more effective, and it is not possible to choose one of the by-lawss and say that it is the best in practice. Because each by-law was issued with the aim of being more perfect, but each time more by-laws were brought to the court. The judicial decisions made as a result of these disputes have a great contribution to the development of environmental law. It is very difficult to determine whether the EIA system, which concerns many sectors, public institutions and organizations, and individuals, has been successful or not. The importance and difficulty of managing a process that has so many stakeholders and requires an integrated approach is obvious. In this respect, it is necessary to remove the obstacles to the management and institutionalization of the public administration that can carry out the EIA process in accordance with its purpos. In our study, the changes within the scope of the new EIA By-Law which entered into force on July 29, 2022 and Council of State decisions on this subject, were examined. In this framework, new articles such as the stakeholder participation plan, which has been made compulsory to inform the public and participate in the process, have been evaluated by emphasizing the new definitions and new provisions introduced by the EIA By-Law.
