s. 361-397 TBB Dergisi 2024 (174) HUKUKİ AÇIDAN DEFİNE KEŞFEDEN KİŞİNİN HAKLARI THE RIGHTS OF THE PERSON WHO DISCOVERS A TREASURE FROM A LEGAL PERSPECTIVE Mehmet Mert ÖZYILDIRIM* Özet: Türk Medeni Kanunu’nda verilen tanıma göre define; bulunmalarından çok zaman önce gömülmüş veya saklanmış olduğu ve duruma göre artık malikinin bulunmadığı kesin olarak anlaşılan değerli şeylerdir. Türk hukuku açısından bu tanıma uyacak nitelikteki bir definenin bulunması halinde ilgili eşya, içinde bulunduğu taşınır ya da taşınmaz mülk sahibine ait olmaktadır. Bulan kişiye ise yalnızca bir miktar ödül verileceği hükme bağlanmıştır. Fakat defineyi bulan kimsenin, ödül alacağına hak kazanabilmesi belirli koşullara bağlıdır. Öte yandan, bulan kişinin kazanabileceği ödül oranları da definenin tesadüfen bulunması ya da arama faaliyeti sonucunda bulunmasına göre değişebilmektedir. Bu bağlamda çalışmada, öncelikle hukuki açıdan definenin tanımı ve koşulları üzerinde durulacak, sonrasında ise keşfeden kişinin hakları çeşitli ihtimallere göre incelenecektir. Anahtar Kelimeler: Define, Kültür ve Tabiat Varlığı, Ödül, Taşınır Mülkiyetinin Kazanılması, Kazı ve Sondaj Abstract: According to the definition given by the Turkish Civil Code, valuable things that have been buried or hidden long before when they were discovered and depending on the case, the things which are precisely understood that has no owner anymore, are deemed as treasure. In terms of Turkish law, if a treasure that corresponds to this this definition is found, the relevant item belongs to the owner of the movable or immovable property in which it is found. It has been decided that only a certain amount of reward could be given to the person who finds a treasure. However, for the right of the person who finds the treasure to receive a reward depends on certain conditions. On the other hand, the amount of the reward that the finder could gain may vary based on whether the treasure is found by chance or as a result of a deliberate searching.
