DEPREMDEN KAYNAKLANAN MANEVİ ZARARLARDAN İDARENİN SORUMLULUĞU* RESPONSIBILITY OF ADMINISTRATION FOR MORAL DAMAGES CAUSED BY EARTHQUAKES Şerife YILDIZ AKGÜL** Özet: Deprem kuşağında yer alan Türkiye bakımından depremden kaynaklanan zararlardan idarenin sorumluluğu konusu her zaman güncel konulardan biridir. Bu çalışmada 6 Şubat 2023 tarihinde yaşanan depremin neden olduğu can ve mal kayıpları nedeniyle oluşan zararların tazmini konusunda manevi tazminatın yeri ele alınmıştır. Bilim ve teknoloji sayesinde depremin yıkıcı etkilerinin büyük ölçüde önlenmesi nedeniyle mücbir sebep olarak kabul edilmeyen depreme karşı manevi tazminat etkili bir hukuki mekanizma olarak ele alınabilir. Zira mahkemece takdiri olarak belirlenen manevi tazminatın hem mağduriyetleri giderme hem de cezalandırıcı işlevi söz konusudur. Bu çalışmada manevi tazminat kurumunun, idareyi önleyici tedbirleri alma konusunda etkili bir hukuki mekanizma olarak ele alınması gerektiği kabul edilmektedir. Anahtar Kelimeler: Deprem, Mücbir Sebep, İdarenin Sorumluluğu, Manevi Tazminat, Manevi Zarar Abstract: In respect to Turkey, which is located in the earthquake zone, the subject of the responsibility of the administration for the damages caused by earthquakes is always one of the current issues. In this study, the place of compensation for moral damages in compensation for damages caused by the earthquake that took place on February 6, 2023 is discussed. Due to the fact that the destructive effects of the earthquake are largely prevented with the help of science and technology, compensation for moral damages can be considered as an effective legal mechanism against an earthquake, which is not considered a force majeure event. Because the compensation determined by the court at its discretion has both a reparative and a punitive function.
