PROTECTION THE USE OF BIOMETRIC METHODS
AND THE COUNCIL OF STATE’S APPROACH

Özet:
Gerek kamu hizmetinden faydalanmak isteyen bireyler-
den gerekse mesaiye devamı kontrol etme veya güvenlik amacıy-
la kamu personelinden biyometrik yöntemler sonucu elde edilen
bilgiler kişisel veri olduğundan, bu tür bir uygulamanın Anayasayla
güvence altına alınan kişisel verilerin korunması hakkı çerçevesinde
değerlendirilmesi gerekmektedir. Bundan dolayı, biyometrik yön-
temlerin kullanımına ve bu yöntemler sonucu elde edilen kişisel ve-
rilerin korunmasına yönelik uygulamanın sınırlarını, usul ve esaslarını
gösteren yasal bir dayanağının bulunması zorunludur.

Abstract:
The information which is obtained from individuals
who want to benefit from public services as well as from civil ser-
vants to control whether they continue their work hours properly
or for security purposes by biometric methods is personal data so,
it must be considered under the framework of personal data pro-
tection rights guarenteed constitutionally. Therefore, there must be
legal basis to illustrate the limits, the procedures and principles for
the use of biometric methods and the protection of personal data
obtained by these methods.
