BAĞLAMINDA DİNİ SEMBOLLERİN KULLANIMI

USAGE OF RELIGIOUS SYMBOLS IN FRANCE WITHIN THE

CONTEXT OF FREEDOM OF RELIGION AND CONSCIENCE

Özet:

İnsan hakları, insanın sırf insan olması nedeniyle doğuş-

tan sahip olduğu vazgeçilemez ve devredilemez haklardır ve bu

haklar insanlığın tarihsel süreç içerisinde elde ettiği insani ve kültü-

rel değerlerin birikimini yansıtır. Tarihsel sürece bakıldığında insan

haklarının bu günlere gelmesi adına yoğun mücadeleler verildiği ve

doğudan batıya bütün medeniyetlerin bu mücadeleyi desteklediği

görülmektedir. Çalışmada, bahsi geçen mücadelelerden en çetini-

ne sahne olan Fransa’da din ve vicdan özgürlüğünün tarihi gelişimi,

bu özgürlük bağlamında dini sembollerin kullanımı ve konuyla ilgili

AİHM’in yaklaşımı incelenmiştir.

Abstract:

Human rights are inalienable and non-transferable

rights inherently possessed by humans simply because of being hu-

man and these rights reflect the accumulation of humanitarian and

cultural values attained by humanity within the historical period.

When the historical period is examined, it is observed that intense

struggles have been waged for the advancement of human rights

and all civilizations from east to west have supported this struggle.

In this study, the historical development of freedom of religion and

conscience and usage of religious symbols within the context of this

freedom in France, where the hardest of the mentioned struggles

took place, have been examined along with the approach of ECHR

in respect thereof.
