CONCLUSION OF ELECTRONIC CONTRACTS IN THE LIGHT

OF RECENT DEVELOPMENTS

Özet:

Elektronik sözleşmeler, günümüzde oldukça yaygın hâle

gelmiştir. Teknolojinin gelişmesiyle birlikte, elektronik sözleşmele-

rin kuruluşuna ilişkin irade beyanlarının elektronik ortamda iletilme

yöntemleri de çeşitlenmiştir. Son dönemde mevzuatımızda elektro-

nik sözleşmeleri yakından ilgilendiren önemli değişiklikler meydana

gelmiştir. 6098 sayılı Türk Borçlar Kanunu ve 6563 sayılı Elektronik

Ticaretin Düzenlenmesi Hakkında Kanun yürürlüğe girmiştir. Bu ça-

lışmada, elektronik sözleşmelerin kurulması konusu, teknolojideki

gelişmeler ve mevzuatta gerçekleşen değişiklikler ışığında, Avrupa

Birliği düzenlemeleri de dikkate alınarak incelenmiştir.

Abstract:

At the present time, electronic contracts have con-

siderably become widespread. Along with the developing tech-

nology, transmission methods of declaration of intents regarding

conclusion of electronic contracts have become diversified as well.

Recently, some important changes related to the electronic con-

tacts have also been observed in our domestic law. The Turkish

Law of Obligations Number 6098 and The Law on the Regulation of

Electronic Commerce Number 6563 entered into force. In this study,

the issue of the conclusion of electronic contracts was examined in

the consideration of technological developments and changes that

happened in legislation by taking European Union regulations into

account.
