Özet:

Avrupa İnsan Hakları Sözleşmesi’nin 11. maddesi ile ko-

runan ve demokratik bir toplumdaki temel haklardan biri olan ba-

rışçıl toplantı ve gösteri yürüyüşü yapma hakkı kullanılırken ve kulla-

nıldıktan sonra devletin yükümlülükleri nelerdir? Göstericilere karşı

kullanılan orantısız gücün sonuçları nelerdir? Bu makalede yazar,

yukarıdaki sorulara, Avrupa İnsan Hakları Mahkemesi’nin içtihatları

ışığında cevap vermeye çalışmıştır.

Abstract:

What are the obligations of the State during and af-

ter the exercise of the right to freedom of assembly and peaceful

demonstration, which is guaranteed under Article 11 of the Europe-

an Convention on Human Rights and which constitutes one of the

fundamental freedoms in a democratic society? What are the con-

sequences of the use of disproportionate force against demonstra-

tors? In this article, the author attempts to respond the aforemen-

tioned questions in the light of the case-law of the European Court

of Human Rights.
