İLAÇ ÜRETİCİSİNİN TEHLİKE SORUMLULUĞU

THE ABSOLUTE LIABILITY OF THE MEDICINE PRODUCER

IN ACCORDANCE WITH THE ARTICLE 71 OF TURKISH CODE

OF OBLIGATIONS

Özet:

Ülkemizde ilaç üreticisinin sorumluluğunu düzenleyen

bir ilaç kanunu mevcut olmadığı gibi üreticinin sorumluluğunu dü-

zenleyen ürün sorumluluğuna ilişkin bir kanun da yoktur. Mevcut

sistemde TKHK kapsamında yapılan tartışmalar çerçevesinde bir yol

bulunmaya çalışılsa da, bu konuda tatmin edici bir sonuca ulaşılama-

maktadır. 6502 sayılı TKHK da bu yol arayışında yardımcı çözümler

içermemektedir. Bu doğrultuda söz konusu çalışmada ilaç üreticisi-

nin tehlike sorumluluğu TBK md.71 bağlamında ele alınmış ve bu ala-

na ilişkin tartışmalar bir zemine oturtulmaya çalışılmıştır.

Abstract:

In our country, neither a medicine code regulating

the liability of medicine producer nor a product liability code regu-

lating the liability of product is available. In the current system alt-

hough there are attempts to find a solution within the framework

of the debates under the scope of the TKHK (Consumer Protection

Law ), a satisfactory conclusion could not be reached. TKHK with

law number 6502 does not provide any supportive solutions in this

quest for solution. Accordingly the absolute liability of the medicine

producer has been dealt with in the context of the article 71 of the

TBK (Turkish Code of Obligations) and discussions on this area have

been tried to base on a ground.
