AİLE KONUTUNUN ÖNEMİ
THE IMPORTANCE OF FAMILY HOME
IN THE NEW TURKISH CIVIL LAW

Özet:
Çalışmamızda Türk Aile Hukukuna yeni giren önemli bir
kavram olan aile konutunun Türk Medeni Kanunu’ndaki düzenleme-
leri incelenmiştir.
Özellikle aile konutu kavramı; unsurları, özellikleri, evlilik birliği
devam ederken ve sonrasında aile konutunu koruma nedenleri, aile
konutu korumasının hukukumuzda başlama ve sona erme süresi ve
aile konutunun eşler ve çocuklar için önemi belirtilmiştir. Aile konu-
tuyla ilgili eşlerin hukuki işlemleri yapma şartları ve bu işlemlerin hu-
kuki sonuçları, aile konutunun mal rejimlerine göre eşlerden birine
tahsis edilmesinin şartları ve hukuki sonuçları ve aile konutunun mi-
ras paylaşımında sağ kalan eşe tahsisinin şartları ve hukuki sonuçları
vurgulanmıştır. Yabancı hukuk sistemlerinde daha uzun bir geçmişe
sahip olan aile konutu kurumunun Türk Hukukuna kazandırılmasının
etkileri incelenmiştir.

Abstract:
In our study, the regulations in the Turkish civil law
about family home which has recently taken place in the Turkish fa-
mily law as an important new concept are examined. Especially con-
cept, components, features of family home, reasons to protect the
family home during the conjugal union and after, beginning and en-
ding notice for protection of family home in our law and the impor-
tance of family home for the spouses and the children are defined.
The terms and legal consequences of starting legal proceedings of
the spouses about the family home, the terms and legal consequen-
ces of allocation of the family home to one of the spouses according
to the property regime, the terms and consequences of the alloca-
tion of family home to the surviving spouse in the circumstances
of sharing heritage are highlighted. The effects of the institution of
family home in Turkish lawwhich has a longer history in foreign legal
systems are examined.
