TİCARETİ SUÇLARINDA ETKİN PİŞMANLIK

EFFECTIVE REMORSE IN PRODUCTION AND TRADE

OF DRUGS AND STIMULANTS

Özet:

Etkin pişmanlık, belirli bazı suçlar bakımından fail yararına

sonuçlar doğuran bir ceza hukuku kurumudur. Suçun tamamlanmasın-

dan sonra özel ceza normunda düzenlenmiş olması şartı ile uygulama

alanı bulan etkin pişmanlık, fiil için öngörülen cezayı ortadan kaldırır

veya azaltır.

Uyuşturucu veya uyarıcı madde imal ve ticareti suçu ile mücadele

kapsamında, TCK’nın 192. maddesinde cezayı ortadan kaldıran ve azal-

tan etkin pişmanlık hükümleri düzenlenmiştir. TCK’nın 192. maddesinin

1. fıkrasında cezayı kaldıran etkin pişmanlık, TCK’nın 192. maddesinin

3. fıkrasında ise cezada indirime yol açan etkin pişmanlık hükümlerine

yer verilmiştir. Çalışmamızda uyuşturucu veya uyarıcı madde imal ve ti-

careti suçlarında, cezayı kaldıran ve cezada indirime yol açan etkin piş-

manlık hükümlerinin uygulanma koşulları ve sonuçları incelenecektir.

Abstract:

Effective remorse is a criminal justice institution that

produces beneficial consequences for the perpetrator for certain cri-

mes. Effective remorse, which finds its application area subject to the

condition that it is regulated under the special punishment norm after

completing the crime, removes or reduces the punishment foreseen

in the act.

Within the scope of combating the production and trade of drugs

and stimulants, effective remorse rules have been regulated in Article

192 of the Turkish Penal Code, removing and reducing punishment. In

paragraph 1 of Article 192 of the Turkish Penal Code, effective remorse

rules, which removes the punishment, and in the third paragraph of

Article 192 of the

Turkish Penal Code, effective remorse rules, which resulted in

reduction in punishment, have been included. In our study, the con-

ditions and consequences of the implementation of effective remorse

rules, which removes the punishment and that leads to reduction in

punishment for the production and trade of drugs and stimulants, will

be examined.
