Özet : MK m.285, evlilik devam ederken veya evliliğin sona
ermesinden başlayarak üç yüz gün içinde doğan çocuğun babası
kocadır demek suretiyle bir karineye, babalık karinesine yer vermiş-
tir. Ancak çocuk evlilik içinde doğmasına veya ana rahmine düşmüş
olmasına rağmen kocadan olmayabilir. Böyle bir halde kanun, ko-
caya, çocuğun kendisinden olmadığını ispatlamak suretiyle onunla
arasında oluşan soybağını ortadan kaldırma imkânı vermiştir. Kanun
tarafından kocaya bu imkân tanınmamış olsa idi koca aslında ken-
disinden olmayan çocuğun bakım, iaşe giderlerini ve nafakasını kar-
şılamak zorunda kalabileceği gibi çocuğun kendisine mirasçı olması
durumu ile de karşı karşıya kalacak idi. İşte bu gibi sorunların aşılması
amacıyla soybağının reddi müessesesi düzenlenmiştir. Bu noktada
tüp bebek ve yapay döllenme bakımından da bu müessesenin de-
ğerlendirilmesi gerekir.

Abstract :
Civil Code, Article 285, gives place to a presumption,
that is paternity presumption, via stating that, the father of the child
who is born while the marriage is continuing or in the period of three
hundred days following the end of the marriage is the husband.
However, the baby may not be from the husband although he/she
is born or he/she settled in the mother’s womb during the marriage.
In such a condition, the Code has allowed the husband removing
the lineage ties between the baby and himself via proving that the
child is not from him. If this allowance was not recognised to the
husband by the Code, the husband should have to supply the caring
and feeding costs and subsistence money as well as he should face
the situation of the child being inheritor to him. Therefore, the
institution of refusal of the family tie was built in order to overcome
these kinds of problems. At this point, this institution should be
evaluated with respect to test-tube baby and artificial fertilization.
