Özet:
Motorlu araç işletenin ve bağlı bulunduğu teşebbüs sahi-
binin sorumluluktan kurtulması, 2918 sayılı Karayolları Trafik Kanunu
m.86 f.1’de düzenlenmiştir. Adı geçen hükme göre, işletenin, tehlike
sorumluluğunu bertaraf edebilmesi için en başta kazanın meyda-
na gelmesinde kendisine veya eylemlerinden sorumlu bulunduğu
kimselere yüklenebilecek bir kusurun bulunmadığını ve araçtaki bo-
zukluğun kazanın oluşumunda rol oynanamadığını ön koşul olarak
ispatlamalıdır. Aksi halde zarar görene karşı sorumluluğu devam
edecektir.

Abstract:
Discharge of responsibility of the motor vehicle
operator and the owner of the enterprise to whom the operator is
subjected to is regulated in the Highway Traffic Code, Number 2918.
According to the mentioned provision, in order to exclude the risk
liability the operator is obliged to prove as prerequisite at first that
there isn’t any negligence that could be encumbered to oneself or
to the ones that the operator is held responsible for their acts in the
occurence of accident and a failure in the vehicle haven’t played any
role in the accident. Otherwise the responsibilty for injured would
continue.
