Özet:
Hukuk düzenince belirli bir hareket serbestîsinin tanındı-
ğı spor müsabakalarında, hukuka aykırı her fiil hukuki sorumluluğu
doğurmayacaktır. Hukuka aykırılığı ortadan kaldıran bir sebep ve/
veya kabul edilen riskin varlığında hukuki sorumluluk gündeme gel-
meyecektir. Ayrıca, haksız fiile ilişkin genel ilkelerden farklı olarak,
spor müsabakalarında sporcunun kusuru da ayrı birtakım özellikler
barındırmaktadır. Basit, düşüncesiz hareketlerle oyun kurallarının
aşılması sonucu oluşan zararların, zarar gören tarafından talep edi-
lemeyeceği esası getirilerek kusurun subjektifleştirildiğini görmekte-
yiz. İhmalin tespitinde oyun kuralları esas alınır. Ancak, bir meslek
olarak icra edilen sporlarda dahi, müsabakanın vermiş olduğu yor-
gunluk, heyecan gibi sebepler neticesinde sporcunun dikkatsiz dav-
ranışı sonucu oluşan zarardan dolayı sporcu sorumlu olmayacaktır.

Abstract:
According to the legal order, in sports competitions
recognized a certain freedom of movement, every unlawful act will
not cause legal liability. In the presence of a reason extinguishing
unlawfulness and accepted risk, legal liability will not come into qu-
estion. Also, as distinct from the general principles on unlawful act,
in sport competitions foul of the athlete contains a number of vari-
ous features. We see that the fault is rendered subjective by being
brought to the basis that the damages occurring as a result of trans-
gressing the game rules with reckless, disregardful movements will
not be demanded by the damaged person. In determination of neg-
ligence, the game rules are taken as a basis. But also in professional
sports, in consequence of the factors such as tiredness and excite-
ment caused by competition athlete will not be held liable for the
damage occurring as a result of his disregardful behavior.
