CONTRIBUTIONS OF EMPLOYEES WORKING
WITH SERVICE CONTRACT

Özet:
Sosyal güvenlik sisteminde üç statüsünden biri olan hizmet
akdiyle çalışmada, çalışanların SGK’ya bildirilmesinin yanı sıra her ay, gün
ve kazançlarının da işverenlerince bildiriminin yapılması gerekmektedir.
Hizmet akdiyle çalışanlara ödenen ücretler, aynen SGK’ya bildirilme-
mekte, ücrete ait bazı unsurlar hiç veya kısmi olarak sigorta primine esas
kazanç dışında tutulmaktadır.
Ücrete ait hangi unsurların; dikkate alınması, alınmaması veya kısmi
olarak dikkate alınması açıkça kanuni düzenlemeyle belirlenmiş olup, bu
konuda diğer düzenlemelerle değişiklik yapılamamaktadır.
Diğer yandan, bu şekilde belirlenen ücretlerin bildirimi, aynı zaman-
da asgari ücretin altından az veya asgari ücretin 6,5 katından fazla ola-
mamaktadır.

Abstract:
Being one of the three statuses in social security system,
in service contract employees and their number of working days and
earnings must be notified to Social Security Institution of Turkey (SGK)
monthly.
Wages paid to employees working with a service contract are not
identically notified to Social Securiy Instution of Turkey (SGK), on the
contrary some components of the wages are excluded partially or comp-
letely from the income dependent on social security contributions.
It is explicitly determined by law that which components of wages
will be the subject to the income dependent on social security contribu-
tions and it could not be altered by other regulations than law.
On the other hand, the wages determined in this way should not be
more than six and a half times (6,5) of the minimum wage or less than
the minimum wage.
