Güçlü Bir Hukuk Devleti için Etik, Demokratik, Laik Eğitim Sistemi ve Eğitim Hukuku

mesine yönelik öneriler getirmektir. Bu çalışma, felsefenin çok yön-

lü ve sorgulayıcı bakış açısını kullanarak, güçlü bir hukuk devleti için

etik, demokratik ve laik eğitim ile eğitim hukuku arasındaki karşılıklı

ilişkiyi, çözümleme ve tartışma üzerine temellendirilmiştir. Eğitim

sistemi açısından, bu kavramlar arasında mantıksal bir ilişki kurula-

mamasının, Türk Eğitim Sistemi’nde yarattığı sorunlar, betimsel bir

yolla ortaya koyulmuş ve çözüm önerileri geliştirilmiştir.

Abstract:

The overall objective of the education system is to

educate “a good man in essence, word and action”. Individuals with

ethical values create secular and democratic civil society by respec-

ting the principles of free thought-tolerance-to shed the kneading

behavior in their personal development. Salvation of the future soci-

ety depends on the existence of an educational system created with

a rule of law and strengthened with universal ethical-democratic-se-

cular values. Only by this way, legal norms may be removed from the

legal system and converted to an internalized law. The aim of this

study is to discuss how a debate is needed on the educational phi-

losophy and system of an individual’s upbringing at the foundation

of the rule of law. For this purpose, ‘the rule of law, individual, right,

the right to train’ concepts are being questioned and the importan-

ce of the ‘democratic-secular ethics-based education philosophy

and system’ are emphasized. In line with the problems at the world

of children and adolescents, education associating with law ‘in the

creation of a new generation and the development of a strong rule

of law’ responsibilities are defined. The method of research, from

the philosophical point of view with a descriptive analysis using sci-

entific and statistical data, reveals the relationship between ‘ethics

with a strong rule of law and democratic-secular education system’.

Giriş

Genel anlamda eğitim, birey davranışlarında, kendi yaşantısı yo-

luyla ya da kasıtlı olarak istendik davranışlar geliştirme süreci

olarak

tanımlanmaktadır. Birey toplum içinde yaşantısını sürdürürken, bir

yandan kültürleme süreci içinde kendi kültürüne bağlı davranışlar

sergilemekte, diğer yandan da kültürlenme sürecini yaşayarak gerek

bireysel gerekse toplumsal yansımaları olan yeni kültür öğelerinin or-

taya çıkmasına katkıda bulunmaktadır. Bu nedenle eğitim bireyin, bi-

lişsel ve duygusal yönlerini, kültürleme süreci içerisinde bilinçli, mak-
