Özet:

Yargıtay 12. Hukuk Dairesi, hamilin rızası hilâfına elinden

çıktığı iddiasıyla çekin iptali talebi kapsamında muhatap bankaya yö-

nelik ödemeden men kararı alması ardından çeki fiilen elinde bulun-

duranın bankaya başvurup bankanın “mahkemece verilen ödeme-

den men kararı nedeniyle çek bedelinin ödenemeyeceği” beyanıyla

karşılaşması üzerine düzenleyen ve diğer müracaat borçluları aleyhi-

ne icra takibi yapmak suretiyle çek bedelinin tahsil edilmesinin müm-

kün olduğunu içtihat etmektedir. Burada incelenen sorun Yargıtay’ın

söz konusu içtihadının hukuken yerinde olup olmadığıdır.

Abstract:

In a lawsuit commenced by the bearer of a check for

cancellation of the check by alleging that the check was lost cont-

rary to his will; the 12

th

Civil Division of the Court of Appeals has ren-

dered a jurisprudence and held possible to collect the amount of the

check via pursuing an enforcement proceeding against the issuer of

the check and the other debtors fromwhom the payment was requ-

ested upon encountering with the objection of “nonpayment of the

amount of the check due to the court’s decision of preclusion from

the payment” by the bank, holding the check following a decision

of preclusion from the payment is obtained by the court is rendered

in relation to the correspondent bank. The issue examined herein

is whether the Court of Appeal’s jurisprudence is legally justifiable

or not.
