Özet:
Bu makalede istisna hali kavramı, egemenlik kavramı ve
egemenliğin icrası üzerinden açıklanacaktır. Ancak bu konu, Carl
Schmitt ve Giorgio Agamben’in teorileriyle sınırlı tutulmuştur. Belir-
siz bir alan olan istisna halinin ele alınmasında hukuk ile siyaset ara-
sındaki ilişki göz önünde bulundurulmalıdır. Çalışmada istisna halinin,
egemenliğin icrasında kural olmaya doğru gittiği vurgulanacaktır.

Abstract:
In this article, the concept of the state of excepti-
on will be explained through the concept and execution of sovere-
ignty. However this subject is confined to Carl Schmitt and Giorgio
Agamben’s theories. In order to address the state of emergency
as an ambiguous sphere, the relationship between law and politics
should be taken into consideration. In the study it will be indicated
that the state of exception evolves to being the principle in the exe-
cution of sovereignty.

1. Giriş
İstisna hali gerek siyasetin hukukla ilişkisinin belirlenmesi, gerek
egemenliğin gücünün gösterilmesi bakımından önemli bir kavramdır.
Carl Schmitt, egemenliği istisna haliyle bağlantılı olarak tanımlamıştır.
O günden bugüne Giorgio Agamben’in de belirttiği gibi istisna haliyle
ilgili kuramsal bir çerçeve çizilememiştir. Aslında bu durum istisna
halinin içkin zorluğundan kaynaklanmaktadır. Hukuk ve siyasetle
ilişkisi çetrefilli olan bu konu üzerinde Schmitt ve Agamben’in görüş-
lerine değinilecektir.
