INSPECTION OF A NEW FACT AND

EVIDENCE AT THE APPEAL STAGE

Özet:

Türk Hukuku’nda sınırlı istinaf sistemi benimsenmiş olup

kural olarak yeni vakıaların ve yeni delillerin yargılamaya getirilmesi

yasaklanmıştır. Yeni vakıaların istinaf aşamasında yargılamaya getiri-

lebilmesine ilişkin hiçbir istisna kabul edilmemiş; buna karşılık ilk de-

rece yargılaması sırasında incelenmeden reddedilen veya mücbir se-

beple gösterilememiş olan delillerin istinaf yargılamasına getirilebil-

mesine imkân tanınmıştır. Kural olarak, istinaf yargılaması sırasında

yeni delil gösterilememekle birlikte, ilk derece mahkemesi nezdinde

delillerin toplanmasına ilişkin bir eksiklik bulunması halinde, deliller

bölge adliye mahkemesi tarafından yeniden toplanarak incelenmek-

tedir.

Abstract:

The limited appeal system is adopted in Turkish Law;

assertions and defenses not alleged by the court of first instance

can not be heard and can not be attributed to new evidences. No

exception is accepted in law to overcome in terms of facts the pro-

hibition to bring new facts during the appeal review; but an excepti-

on is brought for the subject prohibition in terms of evidences. Evi-

dences refused without reviewing by the court of the first instance

although they’ve been submitted duly or which couldn’t be shown

because of force majeure reasons may be reviewed by the regional

court of justice. As a rule, bringing of new evidences is prohibited at

the appeal stage; if there’s a fault about the administration of evi-

dences at the court of first instance, the evidences will be collected

and inspected by the regional court of justice.
