REPORTING THE CRIMES AND PROTECTION OF REPORTERS

Özet:
Kamu güvenliği açısından, terör ve çıkar amaçlı suç ör-
gütleri ile yolsuzluk teşkil eden suç failleri ile sürekli mücadele etmek
gerekir. Bu mücadele sadece kolluk güçleri ile yürütülemez. Vatan-
daşların da üzerine düşen görevi yapması, suç ve suçluları ihbar et-
mesi, tanıklık yapması gerekir. Pozitif hukukumuzda, bazı yolsuzluk
olayları ile gümrük, silah ve uyuşturucu kaçakçılığı gibi önemli suç-
larda, olayların ihbar edilmesi teşvik edilmekte, ödül veya ikramiye
verilmesi öngörülmekte ve bazı koruma tedbirlerinin sağlanacağı be-
lirtilmektedir. Ancak bu konudaki yasal düzenlemeler çok dağınıktır.
Bir çok kanunda ihbarcılar hakkında yer verilen ortak hüküm, bun-
ların kimliklerinin gizli tutulmasıdır. Bazı hallerde ise ödül- ikramiye
verileceği/verilebileceği öngörülmektedir.

Abstract:
It is always necessary for public security to fight aga-
inst terrorism, benefit-oriented criminal organization and criminals
involved in corruption. This fight cannot be conducted solely by law
enforcement officers. To this end, citizens should carry out their res-
ponsibility to report the crimes and give testimony. In the existing
law, reporting the crime is encouraged, reward and bonus are fore-
seen, some protective measures are afforded for important crimes
such as corruption cases, arms and drug smuggling. However, legal
provisions are dispersed on this issue. The common provision envi-
saged for the reporters is about the confidentiality of their identity.
In some instances, it is stipulated that reward and bonus shall be or
can be provided.
