Özet:
Bu makalede, ciddi rahatsızlıklarına rağmen Türkiye ceza-
evlerinde tutulan mahpusların ulusal hukuk içerisindeki mevcut duru-
mu aktarılarak, toplumsal vicdan üzerinde yarattığı kaygının uluslara-
rası metinlerdeki iz düşümleri irdelenmektedir. Çalışmada devamla,
hasta mahpusların herkesle aynı ceza infaz rejimine tabi tutulmasının
meydana getirdiği insanlık dışı uygulamalar, “kanun önünde eşitlik
ilkesi” çerçevesinde tartışmaya açılmaktadır. Ayrıca çalışmada hapis
dışı yöntemlerin olgunlaştırılmasında uluslararası arayışlara değinile-
rek hasta mahpusların bu arayışlar içerisindeki konumu ele alınmakta
ve genel bir değerlendirme ile sonlandırılmaktadır.

Abstract:
In this artical, the current situation of the prisoners
that are kept in the Turkish prisons despite their serious ilnesses is
reported within the national law and the projections of the concern
that it created on social conscience in international texts are studied.
Furthermore, in the study, the inhuman treatments that the sick pri-
soners are exposed to the same enforcements with the other normal
prisoners are brought into question within the framework of “the
equal protection of law.” Moreover, in the study, the international
quests in maturation of non-custodial methods are mentioned and
the positions of the sick prisoners within these quests are handled
and the study ends with a general evaluation.
