Offshore petrol faaliyetlerine ilişkin mevcut hukuki düzenlemele-

re bakıldığında, kıta sahanlığı üzerine yoğunlaşıldığı ve bu yönüyle bu

faaliyetlere ulusal nitelik atfedildiği gözlemlenmektedir.

Mevcut hukuki düzenlemeler birlikte değerlendirildiğinde, başta

çevre kirliliği olmak üzere offshore faaliyetlerden doğan zararların

tazminine ilişkin sorumluluk hükümlerinin farklı farklı sözleşmeler

içerisine yayıldığı ve güçlü bir şekilde uygulanmadığı görülmektedir.

Bu durumun birinci sebebinin, devletlerin daha çok çevre kirliliğinin,

yani zarar verici faaliyetin önlenmesine yoğunlaşması, ikinci sebebi-

nin ise ulusal nitelikteki düzenlemeler ile konunun detaylandırılması

olduğu söylenebilir.
