TO THE SURVIVING SPOUSE IN SHARING INHARITANCE

Özet:
Aile konutu kavramı hukukumuzda 4721 sayılı Türk Medi-
ni Kanunu ile girmiş bir kavramdır. Bu kavramın kendisi yenidir. Mi-
ras hukuku kapsamında eşlerin miras hakkı ve miktarı ile ilgili aslında
hukuk tarihinde ciddi tartışmalar ve gelgitler olmuştur. Aile konutu
kavramının bugünkü geldiği konum aslında söz konusu tartışmala-
rın merkesine oturmaktadır. Türk Medeni Kanunu’nun 652. maddesi
uygar dünyanın miras hukukunda geldiği aşamaya uyumlu olup son
derece yerindedir. Bir eşin ölümü diğer eş için ikinci bir yıkım olma-
malıdır. Söz konusu kanuni düzenleme gecikse de çok yerinde bir
düzenlemedir.

Abstract:
Single family dwelling is a new concept which came
into Turkish Civil Code no. 4721. Within the context of inheritance
law, serius arguments and tides avout rights and portion of inheri-
tance of sğouses occurred in law history. The single family dwelling
as a concept of today took place at the center of these arguments.
The relevant article no. 652 of Turkish Civil Code is so appropriate
in accordance with the development of inheritance law in the civili-
zed world. Loss of a spouse sould not be a second disaster for the
surviving spouse. Although its delay this legal arrangement is a very
important and necessary one.
