THE RIGHT TO TRIAL WITHIN A REASONABLE TIME

IN REEMPLOYMENT PROCEEDINGS

Özet:

Adil yargılanma hakkının en önemli unsurlarından biri

olan makul surede yargılanma hakki, işe iade davalarında hem işçi

hem işveren açısından hayati öneme sahiptir. Kanun koyucu, işe iade

davalarının hızlı bir şekilde sonuçlandırılabilmesi için iş kanununda

özel süreler düzenlemiş ve işe iade davalarının bu süreler içerisinde

sonuçlandırılmasını arzulamıştır. Bu çalışmada, İş Kanununda düzen-

lenen surelerin ve işe iade davalarında bunun uygulanmasının makul

surede yargılanma hakkına etkisi Avrupa İnsan Hakları Mahkemesi

ve Anayasa Mahkemesi kararları çerçevesinde incelenmiştir.

Abstract:

The right to trial within a reasonable time which is

one of the most important elements of fair trial is vital in terms of

both the employee and employer in the reemployment procee-

dings. The legislator has regulated special time periods in labor law

in order to get to be able to have the reemployment proceedings

concluded promptly and has desired these proceedings to be bro-

ught in to conclusion within these periods. In this study, the effect

of the special periods regulated in Labor Law no.4857 and its their

application for in the reemployment proceedings on the right to tri-

al within a reasonable time has been examined in the framework

of the European Court of Human Rights and Turkish Constructional

Court jurisdictions judgments.
