OF SUSPECT AND ACCUSED IN CRIMINAL PROCUDURE LAW

Özet:

Ceza muhakemesi durağan değil, gelişen bir süreçtir.

Bu süreçte gerçeğin kendisi aranmaktadır. Suçlar toplumsal yapı-

ların ayrılmaz parçasıdır, bu nedenle tarih boyunca suç işlenmeyen

bir toplum var olmamıştır. Suçluları bulmak önemlidir. Kimi zaman

şüpheli veya sanık kimliğini bildirmeyebilir. Bu halde, kimliğin tespiti

gerekecektir. Ceza muhakemesi şüpheli veya sanığın fiziki özellikleri-

ni tespit ederek kimliği belirleyecek yöntemler geliştirmiştir. Parmak

izi alımı, fotoğraf çekimi vs. bu gibi yöntemlerdir. Bu çalışmada ceza

muhakemesinde şüpheli ve sanığın kimlik tespitinin nasıl yapılacağı

ve bunun hukuksal boyutları incelenmektedir.

Abstract:

Criminal procedure is not a stabile but a dynamic

process. In this process what is sought is the reality itself.

Throughout the history, crimes are indispensible part of society

since, there has not been a society in which the people in that

society did not experience any kinds of crimes. It is important to

find out the criminals. Sometimes, the suspect or the accused may

not be to identify his or her identity. In this case, it is crucial to

identify his or her identity. Criminal procedure has developed some

ways to determine the identity of suspect or accused by finding

out the physical appearance. These techniques include finger

printing, photography, and so on. In this study, how the identity of

the suspect and the accused is going to be determined interms of

criminal procedure and legal aspects of it has been examined.
