PROTOKOL SIRADÜZENİ
VE ÖTELENEN YARGIÇLIK
ORDER OF PROTOCOL AND IGNORED JUDGESHIP

Özet:
Protokol, kamusal yaşamda devlete, kuruma ve kişiye hak
ettiği ve layık olduğu değeri ve önemi vermektir. Bu nedenle devlet-
ler, kurumlar ve kişiler arasındaki tüm ilişkilerde protokol kurallarına
uymak ulusal, kurumsal ve kişisel saygınlık açısından zorunludur.

Bu
amaca matuf olarak Ulusal ve Resmi Bayramlar ile Mahalli Kurtuluş
Günleri, Atatürk Günleri ve Tarihi Günlerde Yapılacak Tören ve Kut-
lamalar Yönetmeliği yürürlüğe konulmuştur. Yeni Yönetmelikte erk-
ler ayrılığı ilkesine ve görevin önem ve önceliğine uygun düşmeyen
şekilde yargı erkinin temsilcisi yargıçların, protokol sıralamasında
başkentte yasama ve yürütme birimleri karşısında ötelendikleri, ilçe-
lerde ise Cumhuriyet savcılığı–yargıçlık eşitliği bozularak yargıçların,
emirleri altındaki kolluk kuvveti amirlerinin bile gerisine atıldıkları ve
evrensel ilkelere uygun olmayan biçimde Cumhuriyet savcılığının tek
başına yargının temsilcisi kabul edildiği dikkati çekmektedir.

Abstract:
Order of protocol means to take heed of state, ins-
titution and individual that they deserve and merit in formal life.
Therefore, to obey the rules of order of protocol among states,
institutions and people is mandatory for national, institutional and
personal regard. For this purpose, the Directive of Ceremonies and
Celebrations Performed in National and Official Feasts and Local Sal-
vation Days, Atatürk Days and Historical Days is put into effect. In
the new Directive, it is noticed that judges who are the represen-
tatives of judicial branch are ignored, as an inconvenient way with
the principle of seperation of powers and with the importance and
priority of profession, against the units of legislation and execution
in order of protocol in the capital city, also in the towns, by breaking
the equality of prosecution and judgeship. They are pushed behind
the heads of security forces who are under their command, and this
is not consistent with the universal principles, because public prose-
cution is accepted as the only respresentative of the judiciary.
