THE SHADOW OF THE IMPERIAL PRESIDENCY
OVER THE US’ CONSTITUTIONAL ORDER

Özet:
Birçoklarına göre Amerikan başkanlık sistemi ve onun
öngördüğü keskin kuvvetler ayrılığı rejimi benzersiz bir örnektir. Bu
klasikleşmiş kavrayışa göre, ABD başkanlık sisteminin ayırıcı özelliği,
başkanın tek başına temsil ettiği güçlü yürütme organının aynı oran-
da güçlü kontrol mekanizmaları ile kuşatılmış olmasıdır. Ancak, ABD
Anayasası’nın çerçevesini çizdiği bu sistemin pratikte kurucu babala-
rın öngördüğü biçimde işlemediği, hatta bu çizgiden çoktan sapıldığı
yönünde birçok görüş ortaya konulmaktadır. Ünlü siyasi tarihçi Art-
hur Meier Schlesinger Jr.’ın, ABD hükümet sisteminin geldiği noktayı
“emperyal başkanlık” olarak niteleyen çalışması benzer görüşler içe-
risinde özel bir yere sahiptir. Schlesinger’in ABD başkanlarının yürüt-
me organına fiilen güç devşirmelerini betimlemek üzere kullandığı
bu yapı kendisini Amerikan iç ve dış siyasetinde halen kuvvetli şekil-
de hissettirmektedir. Bu çalışmada, sözü edilen emperyal başkanlık
kavramının teorik altyapısı ve tarihsel ilerleyişi yeniden işlenecek,
kavramın güncelliği ABD iç ve dış politikasındaki yansımalarından ör-
nekler verilerek irdelenecektir.

Abstract:
For many, the American presidential system and the
sharp separation of powers is of unique character. According to this
classical perception, the idiosyncratic character of the US presiden-
tial system is that the strong executive branch, which is represen-
ted solely by the President, is surrounded by equally strong control
mechanisms. Nevertheless, there are plenty of views assuming that
the system does not function as the Framers envisaged, and that it
had for so long diverted from its direction. The prominent political
historian Arthur Meier Schlesinger Jr.’s work, which defined the sta-
tus of the US system of government as “imperial presidency”, has
a special position within similar arguments. Schlesinger’s concept,
which he used for defining the presidents’ de facto (and inherent)
power claims to the executive branch, makes itself still evident both
at internal and foreign affairs of the United States. This work, thus,
reiterates the theoretical base and the historical progress of the so-
called imperial presidency fact, and examines the actuality of the
concept by giving examples on its repercussions to the internal and
foreign policies of the United States of America.
