JUDGES AND COURTS OF LAW IN ATHENS IN THE 4TH CENTURY B.C.

Özet:

Bu makalede Aristoteles’in tarihsel ve bilimsel olgulara iliş-

kin kapsamlı derlemeleri arasında günümüze ulaşan “Atinalıların Dev-

leti” adlı eseri temel alınarak MÖ IV. yüzyılda Atina yargı sistemi konu

edilmektedir. Çalışma, söz konusu eseri esas alarak eskiçağ Atina’sı-

nın yargı sisteminin temeli olan yargıçlar, mahkemeler ve yargılama

usulleri tarihsel analiz yöntemleri çerçevesinde incelenmiştir. Eski Yu-

nanlıların siyasal örgütlenmesi, günümüzden farklı olarak ulus devlete

değil, “polis” denilen kent devleti düzenine dayanmaktaydı. Her kent

devleti siyasi olarak bağımsızdı ve kendine yeten bir yapıya sahip ola-

rak kendi kendini yönetirdi. Dolayısıyla her kent devletinin kendi yasa-

ları doğrultusunda, bütün vatandaşlar yürütme ve yasama ile ilgili yet-

kilere sahiptiler. Bu doğrultuda pek çok Yunan kent devletinden biri

olan Atina’da ilk olarak yasalar, yargıçların seçilmesi, yargılama yetki-

leri ile mahkeme türleri üzerinde durulmuştur. Ardından antik edebi

kaynaklarda yer alan yargılamalar için yazılmış söylevlerden yararlanı-

larak MÖ 4. yüzyıl Atina yargı sisteminin genel çerçevesi anlatılmıştır.

Abstract:

This article deals with the judicial in 4

century B.C. At-

hens by means of Aristotle’s Athenian Constitution, one of the extant

comprehensive compilations about historical facts. The article analy-

ses judges, courts of law and judiciary procedures which form the ba-

sis of the ancient Athenian justice system. The political organisation

of the Ancient Greeks was based on the polis, the city state order,

rather than today’s nation states. Politically independent city states

were founded solely on a constitution defining the rights and duties

of citizens, the principles of sovereignty of the law based on citizens’

will and freedom of the individual. Therefore, city states allowed all

their citizens to participate in legislation, execution and jurisdiction

within the frame of their own laws. Accordingly laws, the election of

judges, judicial powers and different kinds of courts of law in Athens

have been touched upon. Finally, general outlines of Athenian judicial

system in 4th century B.C. have been elucidated, based on orations

about proceedings in ancient literary texts.
